Overview

Welcome to Moftail. The terms “Moftail,” “we,” “us,” and “our” refer to Moftail.

Moftail operates this online store and website, including the related information, content, features, tools, products, and services offered through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service (“Terms”), together with the policies referenced in them, govern your access to and use of the Services.

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Nothing in these Terms limits any consumer right that cannot lawfully be waived or excluded.

1. Eligibility and Customer Accounts

You must be at least the age of majority in your place of residence, or use the Services with the authorization and supervision of a parent or legal guardian.

When using the Services, you agree to provide information that is accurate, current, and complete, including your email address, billing information, payment information, and shipping address.

You are responsible for reviewing your information before submitting an order. Moftail is not responsible for delays or delivery failures caused by information that you entered incorrectly, except where applicable law provides otherwise.

If you create or use a customer account, you are responsible for protecting your login credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.

You may not sell, transfer, assign, or license your customer account to another person.

2. Products and Made-to-Order Production

Moftail products are generally made to order after a purchase is placed. Products are produced and fulfilled through third-party print and fulfillment providers.

We make reasonable efforts to display product images, colors, print placement, descriptions, measurements, materials, and other details accurately.

However, the appearance of colors may vary depending on your screen, browser, display settings, lighting, and device. Minor variations may also occur as part of the printing and production process.

Minor variations that do not materially affect the product are not necessarily defects. Material manufacturing defects, significant misprints, damage, or fulfillment errors will be handled according to our Refund & Return Policy.

Product descriptions, designs, prices, colors, sizes, and availability may be changed or discontinued at any time, subject to orders we have already accepted and applicable law.

We may limit the quantity of a product available to a customer, household, geographic area, or order where reasonably necessary.

3. Orders and Acceptance

Submitting an order is an offer to purchase. Receiving an automated order confirmation does not necessarily mean that we have finally accepted the order.

An order is accepted when payment has been authorized and we begin processing or production, or otherwise confirm acceptance.

We may refuse, limit, or cancel an order for legitimate reasons, including:

• Suspected fraud or unauthorized payment
• Incorrect product, pricing, discount, or inventory information
• Unavailable or discontinued products
• Shipping-address or fulfillment restrictions
• Violation of these Terms
• Orders that appear intended for unauthorized resale

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

You agree that purchases are for personal or household use unless Moftail has given prior written permission for another use.

4. Order Changes and Cancellations

Please review the product, design, color, size, quantity, shipping address, and contact information carefully before completing checkout.

Because products are made to order and may enter production shortly after checkout, changes and cancellations are not guaranteed after an order has been submitted.

Contact us immediately through our Contact Page if you notice an error. We will make a reasonable effort to help if production has not begun, but we cannot promise that a change or cancellation will be possible.

Once production has begun, customer-requested changes or cancellations may be unavailable.

5. Prices, Promotions, Taxes, and Payment

Prices are displayed in U.S. dollars unless otherwise stated.

The price charged will be the price displayed at checkout when the order is placed, subject to correction of an obvious error as permitted by law.

Prices, promotions, discounts, and product availability may change without advance notice. Changes will not normally affect an order that we have already accepted.

Taxes, shipping charges, and other applicable fees will be displayed at checkout where required. You are responsible for applicable charges shown before completing payment.

Promotions may have separate eligibility requirements, dates, exclusions, usage limits, or other conditions. If promotion-specific terms conflict with these Terms, the promotion-specific terms will control for that promotion.

You agree to provide valid and authorized payment information and authorize the applicable payment provider to charge the total amount displayed at checkout.

Payments may be processed by Shopify Payments, PayPal, card networks, or other payment providers. Their services may be subject to separate terms and privacy policies.

6. Shipping and Delivery

Moftail currently ships within the United States only.

Each item is made to order and normally requires 2–7 business days for production before shipment.

Once an order has shipped, U.S. Standard Shipping normally takes approximately 2–5 business days.

U.S. Standard Shipping costs $4.89 for orders under $75.

Eligible U.S. orders of $75 or more receive free Standard Shipping unless a different condition is clearly stated at checkout.

Free-shipping eligibility is generally calculated from the merchandise subtotal after discounts and before taxes, unless otherwise stated at checkout.

Production and delivery dates are estimates and are not guaranteed. Delays may occur because of carrier operations, severe weather, seasonal demand, holidays, production issues, incorrect address information, remote delivery locations, or events outside our reasonable control.

Delivery to Alaska, Hawaii, Puerto Rico, U.S. territories, military addresses, PO boxes, or remote areas may require additional time or may be unavailable for certain products.

Tracking information will generally be provided after the carrier accepts the shipment. Tracking may require additional time to begin updating.

If a package appears to be lost, damaged in transit, returned to sender, or incorrectly marked as delivered, contact us so that we can review the available information and determine an appropriate response.

7. Returns, Refunds, Replacements, and Exchanges

Returns, refunds, replacements, and exchanges are governed by our Refund & Return Policy.

Because products are made specifically for the order placed, we generally do not accept returns, refunds, or exchanges for:

• Customer-selected size or color errors
• Changes of mind
• Personal preference unrelated to a product defect
• Products that have been worn, washed, altered, or damaged after delivery

If an item arrives damaged, defective, significantly misprinted, incomplete, or different from the item ordered, contact us within 30 days of delivery.

We may request photographs of the product, packaging, or shipping label to verify the issue.

In most verified defect or fulfillment-error cases, the product does not need to be returned. Do not send any item to Moftail unless we have first provided written return instructions.

8. Accuracy of Information

We make reasonable efforts to keep product descriptions, prices, shipping information, promotions, and other content accurate.

Occasionally, the Services may contain typographical errors, outdated information, inaccuracies, or omissions.

Subject to applicable law, we may correct errors, update information, or cancel an affected order. If an accepted order is cancelled because of our error, we will refund the applicable amount.

9. Intellectual Property

The Services and their content, including Moftail’s names, logos, product designs, illustrations, graphics, photographs, text, slogans, layouts, videos, audio, and other materials, are owned by or licensed to Moftail and are protected by applicable copyright, trademark, design, and other intellectual-property laws.

These Terms grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal, non-commercial shopping purposes.

Without prior written permission, you may not:

• Copy, reproduce, republish, distribute, or commercially exploit our content
• Modify or create derivative works from our designs or materials
• Use our trademarks, logos, product names, or slogans
• Remove copyright, trademark, or ownership notices
• Use our content to train, develop, or operate a commercial system or model
• Represent that you are affiliated with or authorized by Moftail

No license or ownership interest is transferred to you except for the limited right expressly described in these Terms.

Shopify and third-party names, logos, products, and services remain the property of their respective owners.

10. Reviews, Feedback, and Submitted Content

If you submit a review, photograph, comment, suggestion, idea, or other content (“Submitted Content”), you represent that:

• You own the content or have permission to submit it
• The content is accurate and not misleading
• You have disclosed any incentive or compensation connected to it
• The content does not violate another person’s rights
• The content does not contain unlawful, abusive, or malicious material

You retain any ownership rights you have in Submitted Content.

By submitting it, you grant Moftail a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, display, adapt, distribute, and use that content to operate, improve, and promote the Services, to the extent permitted by law.

We may remove or decline to publish Submitted Content that we reasonably believe violates these Terms, applicable law, platform rules, or the rights of another person.

We are not required to treat unsolicited suggestions or ideas as confidential, pay compensation for them, or implement them.

11. Optional Tools and Third-Party Services

The Services may provide access to tools, integrations, payment methods, applications, social-media features, or other services operated by third parties.

Third-party services are governed by their own terms, policies, and practices. Moftail does not control and is not responsible for a third party’s service, content, security, availability, or handling of your information.

You are responsible for reviewing the applicable third-party terms before using those services.

12. Third-Party Links

The Services may contain links to websites or platforms operated by third parties.

A link does not necessarily mean that Moftail endorses, controls, or is affiliated with the third-party service.

We are not responsible for the content, accuracy, security, products, services, or practices of third-party websites. Your use of them is at your own discretion and subject to their terms.

13. Relationship with Shopify

Shopify provides the ecommerce infrastructure used to operate the Services. Purchases made through the Moftail store are transactions between you and Moftail, not between you and Shopify.

Shopify is not the seller of Moftail products and is not responsible for product design, production, fulfillment, customer support, refunds, replacements, or other obligations that belong to Moftail.

Nothing in this section limits any responsibility Shopify may independently have under its own terms or applicable law.

14. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Shopify and other service providers may also process personal information under their own privacy policies.

15. Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

• Violate any applicable law or regulation
• Infringe intellectual-property, privacy, publicity, or other rights
• Submit fraudulent, false, deceptive, or misleading information
• Impersonate another person or entity
• Harass, threaten, abuse, defame, or unlawfully harm another person
• Transmit malware, viruses, or harmful code
• Attempt unauthorized access to an account, system, or network
• Interfere with the operation or security of the Services
• Collect personal information about others without lawful authority
• Send spam, phishing messages, or unauthorized solicitations
• Scrape, crawl, harvest, or systematically extract content or data without permission, except where such restriction is prohibited by applicable law
• Use the Services to facilitate fraud, resale abuse, or payment abuse
• Circumvent access restrictions, security controls, or technical limits

16. Suspension and Termination

We may suspend, restrict, or terminate access to the Services or a customer account if we reasonably believe that:

• These Terms have been violated
• Fraudulent or unlawful activity has occurred
• The Services, Moftail, Shopify, or another person may be harmed
• Suspension is required by law or a service provider

Where reasonably possible and appropriate, we may provide notice or an opportunity to correct the issue.

Termination does not remove obligations or liabilities that arose before termination.

17. Disclaimer of Warranties

Nothing in these Terms excludes or limits a warranty, guarantee, remedy, or other right that cannot lawfully be excluded.

To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, secure, or available at every time or location.

We may temporarily suspend access for maintenance, security, technical issues, service-provider outages, or events beyond our reasonable control.

Except for express promises contained in these Terms, our published policies, or applicable law, we disclaim implied warranties to the fullest extent legally permitted.

18. Limitation of Liability

Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, violation of non-waivable consumer rights, or any other liability that cannot lawfully be limited.

To the fullest extent permitted by law, Moftail and its service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from use of the Services, including lost profits, lost revenue, lost opportunity, or lost data, where such exclusion is legally permitted.

To the fullest extent permitted by law, Moftail’s total liability arising from a product order will not exceed the amount you paid for the specific order giving rise to the claim.

The exclusions and limits in this section apply only to the extent permitted by applicable law and do not reduce any mandatory refund, replacement, warranty, or consumer-protection right.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Moftail harmless from third-party claims, losses, or reasonable expenses arising directly from:

• Your unlawful use of the Services
• Your material violation of these Terms
• Your infringement of another person’s rights
• Content you submit without the required rights or permission

This section does not apply to the extent a claim was caused by Moftail’s own breach, negligence, unlawful conduct, or other responsibility under applicable law.

20. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or modified to the minimum extent necessary.

The remaining provisions will continue in effect unless applicable law requires otherwise.

21. No Waiver and Entire Agreement

A failure or delay by Moftail to exercise a right does not waive that right.

These Terms and the policies incorporated by reference form the entire agreement between you and Moftail concerning the Services and replace prior agreements or communications concerning the same subject matter.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms in connection with a reorganization, financing, merger, acquisition, transfer, or sale of the business or its assets, subject to applicable law.

23. Governing Law and Disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles.

The Osaka District Court in Japan will have exclusive jurisdiction as the court of first instance over disputes arising from or relating to these Terms or the Services.

However, this choice of law and jurisdiction does not deprive you of any mandatory consumer protection or right to bring a claim in another forum that cannot lawfully be waived under the laws applicable where you live.

Before beginning formal legal proceedings, we encourage you to contact us so that both parties can make a reasonable effort to resolve the issue directly.

24. Changes to These Terms

We may update these Terms to reflect changes to the Services, business operations, providers, or legal requirements.

The current version will be posted on this page with an updated “Last updated” date.

Material changes will apply prospectively from the effective date stated in the updated Terms, and we will provide additional notice where required by law.

Your continued use of the Services after updated Terms become effective means that you agree to the updated Terms, except where applicable law requires another form of consent.
